Terms and Conditions

The agreement between you and us when you use SwargVideo. Please read the section on the photograph you upload — it is the one that matters most.

1. This agreement

These terms are between you and swargvideo.com, TODO (“we”, “us”). By uploading a photograph you accept them. If you do not accept them, please do not upload anything.

2. What the service does

You upload one photograph. We use artificial intelligence to produce a short vertical video, roughly 25 to 35 seconds long, showing the person in that photograph ascending a staircase into light — a depiction of swarg. You may optionally add a name and dates, which appear on a memorial card at the end.

The video is a work of imagination produced by software. It is a tribute, not a photograph, not a record, and not evidence of anything.

3. The photograph you upload

By uploading, you confirm all of the following. This is the most important clause in these terms.

  • You own the photograph, or you have permission from whoever does.
  • You are a family member of the person shown, or you have the permission of their family. We have no way to verify this, so we rely entirely on you.
  • If the person shown is alive, you have their explicit permission.
  • The photograph is not of a public figure, a religious deity, or anyone you have no connection to.
  • The photograph does not contain anything unlawful, and is not of a child.

You keep every right you had in your photograph. You grant us only the narrow permission we need to process it, store it and produce your video, and that permission ends when the file is deleted.

We may refuse or remove any upload, without refund, where we reasonably believe this clause has been broken.

4. What artificial intelligence can and cannot do

Please read this before paying for anything.

  • The likeness is approximate. The software works from a single photograph. It aims to preserve the face, but the result is a new image and will differ — sometimes noticeably — from the person as you remember them.
  • Every video is different. Making one twice from the same photograph will not give the same result.
  • We do not guarantee that you will be satisfied with the likeness. This is why we show you the finished video, watermarked, before you pay anything. Please watch it and decide then.
  • Generation sometimes fails for reasons outside our control. When it does, any free video it would have used is returned to you automatically.

5. Free videos, payment and pricing

  • Each device may make a small number of videos free of charge. The current number is shown on the site.
  • Beyond that, making another video is a paid action.
  • Watching your video on our site is free. Downloading a clean, unwatermarked copy is a paid action.
  • Prices are shown in Indian rupees, inclusive of applicable taxes, on the page where you pay.
  • We may change prices at any time. The price you are shown before paying is the price you pay.
  • The free limit is enforced per device using the identifiers described in our Privacy Policy. Deliberately circumventing it is a breach of these terms.

6. Delivery and how long we keep your video

A video usually takes a few minutes. If our systems are busy or our providers are slow, it can take longer.

Your video is deleted within 15 days. Please download it before then. After deletion we cannot recover it, we hold no other copy, and we cannot re-create the same video.

7. What you may do with your video

Once you have paid to download it, you may keep it, share it with your family, show it at a memorial, and post it privately or publicly. You may not resell it or offer it as a commercial service of your own.

The watermarked preview is for you to evaluate. Please do not circumvent the watermark or attempt to capture the preview instead of purchasing the download.

8. Things you must not do

  • Upload a photograph of someone whose family has not consented.
  • Use the service to mock, harass or defame anyone, living or dead.
  • Upload a religious deity, a public figure, or a stranger.
  • Attempt to evade the free limit, or automate requests against the service.
  • Attempt to reach our storage, our database or another person's video.

9. Our responsibility to you

We will provide the service with reasonable skill and care. We cannot promise it will always be available, or that a given video will meet your expectations of likeness.

Where we are at fault, our total liability to you is limited to the amount you have actually paid us for the video concerned. We are not liable for indirect losses.

Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by our negligence, or for fraud. If you deal with us as a consumer, your rights under Indian consumer law stand alongside these terms and are not reduced by them.

10. Governing law

These terms are governed by the laws of India. The courts at Mumbai have jurisdiction, without prejudice to any right you have as a consumer to bring proceedings where you live.
